    FULL TERMS AND CONDITIONS

     

    1. The Promoter

    The promoter is: Kentucky Fried Chicken (Great Britain) Limited of Orion Gate, Guildford Road, Woking, Surrey GU22 7NJ

    1. The competition

      1. The title of the competition is KFC Gravy Black Card Competition 2021.

      2. Win a Gravy Black Card which entitles the winner to up to 5 Regular Gravy portions per day at any KFC UK & Ireland participating restaurant by submitting a statement as to question of "why I deserve to win a Gravy Black Card.

    2. How to enter

      1. The competition will run from 08:00 (GMT) on Tuesday 7 December 2021 (the "Opening Date") to 23:59 (GMT) on Sunday 24 December 2021 (the "Closing Date") inclusive.

      2. All competition entries must be received by the Promoter by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

    To enter the competition all participants must :

    submit the online entry form provided on (kfc.co.uk/gravycard) by the Closing Date.

    1. No purchase necessary and there is no charge to register for use of the website.

    2. The Promoter will not accept:

      1. responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

      2. proof of posting or transmission as proof of receipt of entry to the competition.

    3. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

    5. The competition entries will be judged by a panel of independent judges. The decision of the panel of judges (acting reasonably) will be final.

    1. Eligibility

      1. The competition is only open to all residents in the UK aged 18 years or over, except:

        1. employees of the Promoter or its holding or subsidiary companies;

        2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

        3. members of the immediate families or households of (a) and (b) above.

      2. In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

      3. The Promoter will not accept competition entries that are:

        1. automatically generated by computer;

        2. completed by third parties or in bulk;

        3. illegible, have been altered, reconstructed, forged or tampered with;

        4. photocopies and not originals; or

        5. incomplete.

      4. There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

      5. The Promoter reserves the right to disqualify any participant it believes not to be participating within the spirit of the competition or suspects of participating in any unfair or unjust behaviour. The Promoter reserves the right to use its discretion in all respects and to enforce any penalty or sanction it deems appropriate.

      6. The Promoter shall have the right, where necessary, to undertake all reasonable actions necessary to protect itself against fraudulent or invalid entries including, without limitation, to request further verification as to your identity, age, and other relevant details.

    1. The Promoter may, in its sole discretion, alter or remove any content posted on the Promoter’s platforms or require any participant to alter or remove any content posted on their own feed or platform in connection with the competition.

    1. The prize

      1. The prize is a Gravy Black Card which entitles the winner to up to 5 Regular Gravy per day at any KFC UK & Ireland participating restaurant. To use the Gravy Black Card, the card must be physically presented at the front counter or drive thru when ordering at any KFC UK & Ireland participating restaurant. 

      2. Prizes are subject to availability. There is no cash alternative for the prize.

      3. The prize is not negotiable.

      4. In order to claim the prize you will have three (3) days from the date of the notification email to claim their prize, by replying with the information.

    2. Winners

      1. The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.

      2. The Promoter will contact the winner personally as soon as practicable after the Closing Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

      3. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winner and, if applicable copies of their winning entries, to anyone who emails KFCampaigns@freuds.com or writes to the address set out in condition 1 (enclosing a self-addressed envelope) within one month after the Closing Date of the competition.

      4. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter by email at KFCampaigns@freuds.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

    3. Claiming the prize

      1. If you are the winner of the prize, you will have three (3) days from the Closing Date to claim the prize. If you do not claim the prize by this date, your claim will become invalid.

      2. The prize may not be claimed by a third party on your behalf.

      3. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 2 days of the Closing Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

      4. The Promoter does not accept any responsibility if you are not able to take up the prize.

      5. If the Promoter finds that the Gravy Black Card details have been published and/or shared on any public platform, or the Promoter identifies transactions across a wide geography at the same time,  the Promoter reserves the right to terminate this competition immediately.

    4. Limitation of liability

    Insofar as is permitted by law,  the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

    1. Ownership of competition entries and intellectual property rights

      1. All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

      2. By submitting your competition entry and any accompanying material, you agree to:

        1. assign to the Promoter all your intellectual property rights with full title guarantee; and

        2. waive all moral rights,

    in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

    1. You agree that the Promoter may, but is not required to, make your entry available on its website www.kfc.co.uk/gravycard and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry for such purposes.

    2. The Promotor reserves the right to use the competition entry imagery provided by all participants for promotional purposes, including but not limited to the Promotor’s website, social media channels (Facebook, Twitter, Instagram), and for marketing and PR purposes without additional compensation (except where prohibited). 

    3. The winner will be required to sign a content release form and participants understand that, by participating in the competition, they agree to sign that form in the event they are the winner. The Promotor reserves the right to use imagery and/or footage provided by the winner for promotional purposes, including but not limited to the Promotor’s website without additional compensation (except where prohibited). 

    4. The winner agrees to be contacted by the Promoter regarding any future campaigns where relevant.

    5. If at any time you wish to withdraw from the Competition, your request should be made in writing to the Promoter via email at KFCampaigns@freuds.com

    1. Data protection and publicity

    The Promoter will only process your personal information as set out in the https://www.kfc.co.uk/privacy-policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.

    1. General

      1. Any questions, comments or complaints regarding this competition should be directed to the Promoter.

      2. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary these terms and conditions.

      3. The Promoter will not be responsible or liable for: (a) any failure to receive entries due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or entries; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the promoter; or (e) any printing or typographical errors in any materials associated with this competition.

      4. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

      5. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

      6. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
